DCSki Guidelines and Advertising Agreement

Our goal is to provide advertisers with an effective, affordable medium for reaching winters sports enthusiasts in the Mid-Atlantic region of the United States and beyond.

DCSki (or DCSki.com) is a web site operated by DCSki, LLC, a Limited Liability Company based in the state of Maryland.

This page contains important details for all advertisers. By advertising on DCSki, you agree to all of the conditions on this page. These guidelines are subject to change with no prior notice.

Suitability of advertising material

DCSki is a family site. As a result, we reserve the right to refuse advertisements which are, in our sole opinion, potentially offensive to the DCSki readership.

No minimum or maximum impression or click-through guarantees

Advertising packages are sold on a seasonal or monthly basis. DCSki does not charge per impression (delivery of advertisement to user’s screen) or per click-through (user clicking on an advertisement). DCSki places no upper limit on the number of impressions an advertisement makes, but also does not guarantee a minimum number of delivered impressions or click-throughs. Frequency of advertisement impressions is dependent on how many advertisements are in DCSki’s advertisement pool and how many visits DCSki receives from readers. Visits fluctuate greatly depending on factors outside of our control, such as current snow conditions. Our goal is to maximize exposure for all advertisers.

Advertisement dimensions and file size

Images for advertisements must have dimensions which are compatible with the structural layout of DCSki pages. The dimensions and allowable file sizes for advertisements are based on the package selected. Upon selecting an advertising package, each advertiser will receive a formal specifications sheet which outlines the requirements for each advertisement. Note that the only acceptable image formats for advertisements are non-animated GIF, JPEG, and PNG.

Unless otherwise negotiated, each advertiser is responsible for supplying all content for their advertisements, consistent with the specifications outlined for the package they have chosen. DCSki does not provide any design services for advertisements, unless separately negotiated.

The exact placement of advertisements on DCSki pages may vary across different pages on the site, and due to continued improvements and adjustments to page layouts. Some DCSki pages do not show any advertisements.

The web is a dynamic environment, and DCSki, LLC cannot guarantee a consistent user experience for all readers across all current and future web viewing applications and devices. The display of page components such as advertisements may be negatively affected by the reader’s choice of device. In addition, outside of DCSki’s control, some readers use software that automatically blocks the display of advertisements. Ads sold directly by DCSki are served directly from our own server, vs. third-party sites, so they are less likely to be affected by ad blockers.

Replacing advertisements

Many advertising packages on DCSki include the ability to swap out advertisements throughout the course of the advertising campaign. We encourage advertisers to refresh content from time to time, for example to promote upcoming events or specials. DCSki will attempt to perform advertisement substitutions in a timely fashion (often within 24 hours), but please allow up to a week for a substitution to occur.

Cancellation of advertising package

DCSki, LLC reserves the right to cancel advertising packages at any time. In such cases, a pro-rated refund would be provided to each affected advertiser.

Advertisers also have the right to cancel their advertising package at any time. Depending on the circumstances, and at our sole discretion, a pro-rated refund may be provided, but is not guaranteed.

Hardware, software, or network failures

The Internet is unpredictable, and DCSki, LLC and its Editor, M. Scott Smith, are not responsible for any hardware, software, or network failures beyond our control that might adversely affect the delivery of advertisements to the DCSki readership. This includes outages caused by “hacking” (unauthorized modification) of the DCSki web site by a third party, or outages caused by an unauthorized denial of service attack levied against DCSki by a third party. The DCSki web site is hosted on servers that are located within an independent Web Presence Provider’s facilities. DCSki, LLC is not responsible for any hardware, software, or network problems caused by the Web Presence Provider or its service providers, or failures caused by software installed on the Web Server. However, if the DCSki web site experiences an extended outage (defined as a period of 7 consecutive days or greater where users cannot access the site and/or advertisements are not displayed), at our discretion, DCSki, LLC will provide a pro-rated refund to advertisers or extend the length of their advertising package. Our goal is to keep DCSki on-line 24 hours day, 7 days a week, and to exceed the expectations of our advertisers in every way. DCSki has only experienced a few days of outage since its debut as a web site in July, 1997.

Editorial comments by DCSki’s readership

DCSki nurtures a community of winter sports enthusiasts by encouraging readers to publish their own comments. Readers may do this in various areas of the site, such as the DCSki Forum or by commenting on specific news articles. DCSki, LLC is not responsible for the accuracy or suitability of comments posted by readers. However, DCSki, LLC regularly monitors comments and makes an attempt to address comments which are inaccurate or inappropriate as quickly as possible. DCSki attracts a mature readership and historically has not had problems in this area.

Limitation of liability and damages

The entire liability of DCSki, LLC and its Editor, M. Scott Smith, for any reason, shall be limited to the amount paid by the customer to advertise on the DCSki web site. To the maximum extent permitted by applicable law, DCSki, LLC, its Editor, M. Scott Smith, and any contributing writers, are not liable for any indirect, special, incidental, or consequential damages (including, but not limited to: damages for loss of business, loss of profits or investment, or the like) resulting from advertising on the DCSki web site, whether based on breach of contract, negligence, product liability or otherwise. DCSki, LLC’s total liability to you for actual damages for any cause whatsoever will be limited to the amount paid by you to advertise on the DCSki web site.

Your obligations

As a DCSki advertiser, you agree to pay the advertising package fee in full in a timely fashion and to provide the necessary advertising images and content, adhering to the specifications provided directly to you by DCSki’s Editor. You also agree to all of the terms on this page.

DCSki accepts payment in the form of a check. Full payment is normally due within 30 days of the initiation of the advertising package, unless other arrangements are made in advance. Late payments may be charged a penalty at the rate of 1.5% of outstanding balance per month. DCSki does not provide an Agency discount. Note also that prices and specifications for advertising packages are subject to change at any time, without prior notice.
